Utah R68-7 — Who May Apply Pesticides on a Campus, and the Records They Keep

What It Says (Verbatim)

R68-7-7(7), first sentence:

“(7) Structural and Health Related Pest Control. This category includes applicators applying pesticides in, on, or around any public or private food handling establishment; dwelling, educational institution, or medical institution; industrial building; business establishment; packing house; food-processing facility; prison; manufacturing facility; grain elevator; or any other structure or area, or immediately adjacent structure or area, to control pests.”

R68-7-2(8):

“(8) "Non-commercial pesticide applicator" means any person working as an employee of any entity, firm, or government agency who uses or demonstrates the use of any restricted use pesticide on the entity's property, or any property occupied, managed, or under the direction or authority of any entity, firm, or government agency, and does not require a commercial pesticide applicator's license.”

R68-7-12(1)(a):

“(a) A non-commercial pesticide applicator license is required for applying restricted use pesticides for a city, county, state, or federal government entity, or for corporations, businesses, or any other entity that does not require a commercial pesticide applicator license.”

R68-7-11(11), opening:

“(11) Records Maintained. Commercial applicators shall keep and maintain records of any pesticide applications.

(a) These records shall be recorded within 24 hours after the pesticide application is made.”

R68-7-11(11)(c):

“(c) Records shall be kept for a period of at least two years from the date of the pesticide application and shall be available for inspection by the department upon request.”

Utah Code 4-14-102(4):

“(4) "Certified applicator" means an individual who is licensed by the department to apply:

(a) a restricted use pesticide; or

(b) a general use pesticide for hire or in exchange for compensation.”

What It Means in Plain Language

A contractor applying pesticides in or around campus buildings to control pests generally works under the structural category, which names “educational institution” and “food handling establishment”; fumigation and wood-destroying organism work fall under separate categories (R68-7-7(13) and (15)). Every commercial application must be recorded within 24 hours, and the record kept at least two years. R68-7-11(11)(b) lists what the record contains: whom the work was for, where, the area treated, the target sites, the date and time, the product with its EPA registration number and mix rate, the amount applied, the purpose and target pest, and the applicator's name, business address, and license number.

University staff who apply restricted use pesticides need a non-commercial license (R68-7-12(1)), and keep a parallel record (R68-7-12(8)). The definition and the license requirement are both written around restricted use pesticides. Whether a university employee applying only general-use products in the university's own buildings needs a license is not answered by these sentences, and is listed as an open question.

A correction on the citation: application records for commercial applicators are R68-7-11(11), not R68-7-16. R68-7-16 covers the duties of pesticide businesses, including training records and display of the business license number on proposals, service records, and vehicles.

Anyone applying pesticides on a Utah campus: contractors, under commercial licensing; and institution employees, under non-commercial licensing for restricted use pesticides.
