What It Says (Verbatim)

R392-800-2, Applicability:

“(1) Unless exempted in Subsection R392-800-2(2), this rule applies to any person who owns or operates a facility or place listed in Section 26B-7-402 that is made available for public use. This rule applies to the repair, maintenance, and operation of public places as defined by this rule.

(2) This rule does not apply to:

(a) a private residence or its premises;

(b) a publicly or privately owned property that is not operated or intended for public use; or

(c) a facility, institution, location, or place whose primary purpose or intent is already regulated by another rule promulgated by the Department under Title R392, Health and Human Services, Population Health, Environmental Health.”

R392-800-3(11)(a), definition of Public place, opening:

“(11)(a) "Public place" means a place, facility, or location listed in Section 26B-7-402 which may be an indoor or outdoor area, whether privately or publicly owned, to which persons not employed at the place have general and regular access by right or by invitation, expressed or implied, whether by payment of money or not, including:”

R392-800-3(11)(a)(xiii):

“(xiii) state, county, or municipal institutions, including hospitals.”

R392-800-3(11)(b):

“(b) A public place may also include public buildings and grounds, as well as centers and places used for public gatherings such as auditoriums, theaters, libraries, museums, concert halls, indoor arenas, and meeting rooms.”

R392-800-4(4):

“(4) The operator may be required to abate a pest infestation. Abatement activities shall comply with Title 4, Chapter 14, Utah Pesticide Control Act.”

R392-800-8(2):

“(2) Where necessary, any reasonable means shall be employed to eliminate or control infestations of vectors or pests within a public place, including approved screening or other approved control of outside openings in structures.”

What It Means in Plain Language

R392-800 is the rule that remains when no more specific R392 rule applies. Where it applies, it requires “any reasonable means” to eliminate or control infestations of vectors or pests, and provides that an operator may be required to abate a pest infestation, with abatement done in compliance with the Utah Pesticide Control Act.

Its definition names categories that describe much of a public campus: “state, county, or municipal institutions,” and “public buildings and grounds,” auditoriums, theaters, libraries, museums, concert halls, indoor arenas, and meeting rooms, all places to which people not employed there “have general and regular access.” Its exclusions matter as much. A campus kitchen whose primary purpose is regulated by the food service rule, or an on-campus school regulated by R392-200, is outside it under R392-800-2(2)(c). Property “not operated or intended for public use” is outside it under (2)(b).

Whether a particular building fits the definition, including a residence hall, where access is by assignment rather than open to the public, is not settled by the text, and this page does not settle it.

Who It Applies To

Owners and operators of places listed in Utah Code 26B-7-402 and made available for public use, except as excluded in R392-800-2(2). Utah Code 26B-7-402 itself was not read for this page.
