FDA Food Code 2022 and Utah R392-100 — Pest Control in Campus Dining and Concessions

What It Says (Verbatim)

Food Code 2022, Section 6-501.111, Controlling Pests:

“The PREMISES shall be maintained free of insects, rodents, and other pests. The presence of insects, rodents, and other pests shall be controlled to eliminate their presence on the PREMISES by:

(A) Routinely inspecting incoming shipments of FOOD and supplies;

(B) Routinely inspecting the PREMISES for evidence of pests;

(C) Using methods, if pests are found, such as trapping devices or other means of pest control as specified under §§ 7-202.12, 7-206.12, and 7-206.13; Pf and

(D) Eliminating harborage conditions.”

The Food Code's definition of a food establishment names institutions. Section 1-201.10(B) defines it as an operation that:

“stores, prepares, packages, serves, vends FOOD directly to the CONSUMER, or otherwise provides FOOD for human consumption such as a restaurant; satellite or catered feeding location; catering operation if the operation provides FOOD directly to a CONSUMER or to a conveyance used to transport people; market; vending location; conveyance used to transport people; institution; or FOOD bank.”

Utah R392-100-4(1)(b), Incorporation by Reference:

“(b) the 2022 version of the U.S. Food and Drug Administration Food Code (Food Code), Chapters 1 through 8, Annex 1 Parts 8-6 through 8-9 and the December 2024 version of the Supplement to the 2022 Food Code, with the stated exceptions and amendments as established in Subsections R392-100-4(2) and R392-100-4(3).”

Utah R392-100-3(1), exemptions, complete:

“(1) The following food service establishments are exempt from the requirements of this rule:

(a) a mobile food business;

(b) a certified or licensed child care facility, including a residence, that provides care for 16 or fewer children;

(c) a residential treatment program, residential support program, or recovery residence, as defined in this rule and in Rule R392-110, that provides a 24-hour group living environment for between four and 16 individuals unrelated to the owner or provider;

(d) an agritourism food establishment; and

(e) a microenterprise home kitchen.”

What It Means in Plain Language

Section 6-501.111 is a performance standard with four named parts: inspect incoming shipments, inspect the premises, use approved control methods when pests are found, and eliminate harborage. The standard is “free of insects, rodents, and other pests,” controlled “to eliminate their presence.” Subsection (C) carries the Pf (Priority Foundation) designation, the Food Code's middle tier of violation severity.

Utah incorporates the 2022 Food Code with the December 2024 Supplement. None of the provisions Utah leaves out or amends is Section 6-501.111, and R392-100 adds no pest text of its own. The exemption list does not name colleges, universities, or institutional dining. A campus dining hall, retail outlet, catering kitchen, or concession stand that is a food establishment is subject to the same pest section as a restaurant.

Who It Applies To

Food establishments in Utah, whether operated by the university or by a contracted food service company, inspected by the local health department for the county where the campus sits. Where a campus kitchen's inspection history can be looked up is listed on the dining zone page.

FDA has since published a 2026 Food Code; Utah's rule incorporates the 2022 edition.
