Utah R381-100 — Pest Control in Licensed Child Care Centers

What It Says (Verbatim)

R381-100-15(2), Health and Infection Control:

“(2) The provider shall take safe and effective measures to prevent and eliminate the presence of insects, rodents, and other pests.”

R381-100-13(9), Child Safety and Injury Prevention:

“(9) The provider shall ensure that any toxic or hazardous chemical, including any cleaner, insecticide, lawn product, and flammable, corrosive, and reactive material is:

(a) disposed of properly;

(b) inaccessible to any child;

(c) stored in a container labeled with the contents of the container; and

(d) used according to manufacturer instructions.”

What It Means in Plain Language

The standard is a performance standard: measures that are “safe and effective,” aimed at preventing and eliminating pests. The rule has no IPM plan requirement, no notification requirement, and no applicator requirement of its own. “Pesticide” does not appear in the rule; “insecticide” appears once, in the storage and use provision.

A child care center on a campus is excluded from the school rule, R392-200 (R392-200-3(2)(a)). If it is a licensed center, this is the pest provision of its licensing rule; other rules, such as OSHA's for its employees, may also reach it.

Who It Applies To

Providers licensed under R381-100. Most Utah universities operate child care or early childhood laboratory programs on campus. As of September 25, 2026, the state's licensing records list eleven campus programs as licensed Child Care Centers and three as Child Care Exempt Programs; the programs and their record numbers are on the child care zone page. Whether this rule reaches an exempt program is not established here.
